What Can a Will Do?
Most people know that they can use a last will and testament to determine how their property is distributed when they pass away. But wills actually have a number of other uses. By drafting a living will in conjunction with your last will and testament, you can:
- Establish Health Care and Financial Power of Attorney (POA). Determining Health Care and Financial POA allows you to appoint an individual (or individuals) to look after your health and finances if you become incapacitated or lack the mental capacity to make decisions.
- Establish guardianship. You can use your will to suggest a guardian for your child if you pass away or become incapacitated. The court will prioritize the person you suggest when appointing a guardian for your child if you can't care for them.

Drafting a Will in NC
Fortunately, drafting a will in South Carolina is relatively easy. You should work with an estate planning lawyer to draft your living will and last will and testament, which will include provisions for PoA, guardianship, and how you want to distribute your estate when you pass away.
After drafting your will, you must sign it in front of at least two witnesses, who must also sign the will. During probate, the court will check in with those witnesses to verify the integrity of the will.
If you wish to invalidate your will, you must destroy it, have someone else destroy it for you, or formally draft a new will and revoke the old one in the terms of the new will.
