Grounds for Trust Litigation in North Carolina

Chapter 36C of the North Carolina General Statutes, known as the North Carolina Uniform Trust Code, governs many trustee duties and proceedings. The appropriate claim depends on whether the dispute concerns the trust’s validity, its administration, or both.

A trust contest challenges the validity of a trust or one of its provisions. The settlor, meaning the person who created the trust, must have had the required mental capacity and acted voluntarily when signing it.

• Lack of Mental Capacity: The settlor allegedly couldn’t understand the nature and effect of creating or changing the trust.

• Material Mistake: The terms may not reflect the settlor’s intent because of a significant error.

Grounds for trustee removal may include a serious breach of trust, unfitness, persistent failure to administer the assets effectively, or conflict among co-trustees that substantially impairs administration. Removal isn’t automatic simply because beneficiaries disagree with a decision.
